Terms of Service

1. Acceptance of Terms

By accessing or using Dinkwize ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Dinkwize is a video coaching workspace that helps pickleball coaches review game footage and deliver feedback to their players. The Service includes:

• Video upload and storage for game footage.
• Private video-processing and review tools for authorized coaches.
• Coach-authored Match Stories, voice notes, clips, and written feedback.
• Private relationships between coaches and their invited students.
• Optional paid services when those services are offered.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use the Service.
• One person may not maintain more than one account.

4. Content and Intellectual Property

• Your Content: You retain ownership of videos and content you upload. By uploading, you grant Dinkwize a license to process, analyze, and store your content for the purpose of providing the Service.
• Private Processing Materials: Dinkwize may create automated analysis and drafts as private coach work product. These materials are not delivered directly to players. Only feedback an authorized coach deliberately delivers becomes part of the player's Match Story.
• Platform Content: The Dinkwize platform, design, and technology are owned by Dinkwize and protected by intellectual property laws.

5. Coach Terms

If you register as a coach on the platform:

• You must hold valid coaching certifications as specified during registration.
• You agree to provide professional, constructive, and timely feedback.
• You are responsible for reviewing and approving all feedback you deliver.
• You may not expose private processing materials directly to players.
• Commission rates are set according to your coach tier and are subject to change with notice.
• Dinkwize reserves the right to remove coaches who do not meet quality standards.

6. Payments and Subscriptions

• Subscription fees are billed in advance on a recurring basis.
• You may cancel your subscription at any time. Access continues until the end of your billing period.
• Credits purchased are non-refundable except as required by law.
• Prices may change with 30 days' notice.

7. Acceptable Use

You agree not to:

• Upload content that violates others' rights or contains inappropriate material.
• Attempt to reverse-engineer, scrape, or misuse private processing systems.
• Use the Service for any unlawful purpose.
• Harass, abuse, or harm other users or coaches.
• Create fake reviews or manipulate platform ratings.

8. Disclaimers

• Coach feedback is provided for informational and coaching purposes only. It is not a substitute for professional medical advice regarding injuries or physical conditions.
• The Service is provided "as is" without warranties of any kind, express or implied.
• Automated processing may be incomplete or inaccurate and requires coach review.

9. Limitation of Liability

To the maximum extent permitted by law, Dinkwize shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
